Terms and Conditions
These Terms and Conditions (“Terms”) constitute a legally binding agreement between Eviz Design (“Company,” “we,” “our,” or “us”) and the customer (“Customer,” “you,” or “your”) for the design, manufacture, supply, and installation of interior design solutions and related services.
By booking a project with Eviz Design, making any payment, or approving a quotation, design, or work order, you agree to these Terms and Conditions.
1. About Eviz Design
Eviz Design is an interior design and execution company providing end-to-end residential and commercial interior solutions, including but not limited to:
- Modular kitchens
- Wardrobes
- TV units
- Crockery units
- Beds and custom furniture
- False ceiling
- Painting
- Electrical work
- Plumbing
- Civil renovation
- Wallpaper and wall panels
- Lighting solutions
- Home decor and furnishing
2. Definitions
Customer
Any person, company, or legal entity purchasing products or services from Eviz Design.
Project
The complete scope of services and products agreed upon between Eviz Design and the Customer.
Quotation
The detailed estimate provided by Eviz Design for the Project.
Site
The property where the work is to be executed.
Handover
The date on which the Project or relevant portion is delivered to the Customer.
OEM Products
Products supplied by third-party manufacturers such as appliances, hardware, lighting, accessories, and branded materials.
3. Pricing and Payment Terms
3.1 Pricing
The final Project cost depends on:
- Final measurements
- Design approval
- Material selection
- Finishes
- Site conditions
- Customizations
- Scope changes
The final Project value may vary by approximately 5% to 15% from the initial quotation. Custom and non-standard items may result in larger variations.
3.2 Payment Schedule
Unless otherwise agreed in writing, the following payment structure shall apply:
Booking Amount
10% of the total quotation value payable at the time of order confirmation.
Design Finalization Stage
20% of the total quotation value payable upon final design approval.
Production Stage
40% of the total quotation value payable before manufacturing or procurement begins.
Final Payment
30% of the total quotation value payable before dispatch and installation.
3.3 Payment Conditions
- Work will proceed only after receipt of the applicable milestone payment.
- All payments must be acknowledged by Eviz Design through official invoice receipt, WhatsApp confirmation, or payment acknowledgment.
- GST and applicable taxes will be charged as per law.
- Payment gateway or transaction charges may apply depending on the payment method.
3.4 Additional Charges
Additional charges may apply for:
- Design revisions after approval
- Additional scope of work
- Site constraints
- Material price escalation
- Staircase unloading
- Demurrage/storage
- Rework due to Customer-requested changes
3.5 Late Payment and Storage Charges
If final payment is not made by the due date, storage or demurrage charges of ₹500 per day may be levied until payment is received in full.
4. Quotation Validity
- Initial quotations are valid for 30 days.
- Approved quotations are valid for 90 days.
- If execution is delayed beyond 90 days, revised pricing may apply.
5. Site Readiness
The Customer must ensure the Site is ready for execution, including:
- Uninterrupted site access
- Availability of electricity and water
- Completion of builder work not included in our scope
- Necessary approvals from society or builder
- Lift access, if applicable
Delays caused by site unpreparedness will result in timeline extensions.
6. Design Approval and Changes
- Production begins only after written approval of designs and materials.
- Changes after approval may result in additional cost and timeline extension.
- Changes after production begins may not be possible.
7. Delivery and Installation Timeline
The Project timeline begins only after all of the following are completed:
- Final design approval
- Receipt of due payments
- Site readiness confirmation
- Signed quotation or work order
All timelines provided are estimates and may vary depending on project complexity.
8. Delivery Guarantee
Any timeline commitment is subject to fulfillment of all Customer obligations.
Eviz Design shall not be liable for delays caused by:
- Payment delays
- Site readiness issues
- Customer-requested changes
- Builder or society restrictions
- Third-party vendor delays
- Force Majeure events
9. Materials and Product Availability
Materials and products are subject to market availability.
If a selected product becomes unavailable, Eviz Design may provide:
- A similar alternative, or
- A revised selection with price adjustment
Minor differences in shade, grain, texture, and finish are natural characteristics and not defects.
10. Installation and Finishing Notes
The following are considered normal and shall not be treated as defects:
- Pencil markings
- Minor touch-up work
- Surface dust
- Small gaps due to wall unevenness
- Natural color variation
Customers are advised to complete final paint touch-ups after all interior work is finished.
11. Warranty Policy
Modular Woodwork Warranty
Eviz Design provides up to 10 years limited warranty on modular woodwork against manufacturing defects and installation issues, unless otherwise stated.
OEM Products
Appliances, hardware, accessories, and branded products are covered by the respective manufacturer warranty.
Service Warranty
Electrical, plumbing, painting, and false ceiling services may carry warranties as mentioned in the quotation.
12. Warranty Exclusions
Warranty does not cover:
- Normal wear and tear
- Scratches, dents, and chips
- Water seepage or leakage
- Misuse or negligence
- Pest damage
- Rust due to moisture
- Sunlight fading
- Unauthorized repairs
- Force Majeure events
13. Service and Maintenance
Eviz Design provides three complimentary service visits within 12 months from handover for minor adjustments such as:
- Shutter alignment
- Hinge adjustments
- Channel adjustments
- Tightening fittings
Unused visits expire after 12 months. Additional visits will be chargeable.
14. Cancellation Policy
Within 72 Hours of Booking
100% refund of the booking amount, provided:
- Site measurement has not been completed, and
- Design work has not commenced
After 72 Hours or After Design Work Begins
The booking amount is non-refundable.
After Production Begins
No refund shall be applicable, and the Customer remains liable to pay the outstanding balance.
Refunds, if applicable, will be processed to the Customer’s bank account.
15. Customer Responsibilities
The Customer agrees to:
- Provide accurate information
- Approve designs on time
- Make payments as scheduled
- Provide uninterrupted site access
- Obtain necessary permissions
- Protect installed materials after handover
16. Customer Conduct
Customers shall treat Eviz Design representatives respectfully.
Eviz Design may suspend work if:
- The work environment is unsafe
- Representatives are subjected to abuse
- Applicable laws or society rules are violated
Any resulting delay shall not constitute breach by Eviz Design.
17. Third-Party Products and Vendors
Certain products and services may be sourced from third-party vendors.
Eviz Design acts as a facilitator and shall not be liable beyond applicable manufacturer warranties and contractual obligations.
18. Force Majeure
Eviz Design shall not be liable for delays or failure due to events beyond reasonable control, including:
- Natural disasters
- Floods
- Fire
- Pandemic
- Government restrictions
- Labor strikes
- Supply chain disruptions
- War or civil unrest
19. Limitation of Liability
Eviz Design’s total liability shall not exceed the amount paid by the Customer for the affected scope of work.
Eviz Design shall not be liable for indirect, incidental, special, or consequential damages.
20. Intellectual Property
All designs, drawings, renderings, and documentation prepared by Eviz Design remain its intellectual property unless otherwise agreed in writing.
The Customer shall not reproduce or share these materials with third parties without written consent.
21. Photography and Marketing Rights
The Customer grants Eviz Design permission to photograph and video the completed Project for use in:
- Portfolio
- Website
- Social media
- Marketing materials
Customers may opt out by informing Eviz Design in writing before handover.
22. Privacy Policy
The Customer authorizes Eviz Design to collect and process personal information for:
- Project execution
- Customer support
- Warranty and service
- Communication via phone, SMS, and WhatsApp
Customer data may be shared with vendors and service partners strictly for project execution purposes.
23. Cleaning Services
After installation, Eviz Design will provide basic cleaning, including:
- Dusting
- Sweeping
- Mopping
- Cleaning cabinet interiors and exteriors
Deep cleaning is not included unless specifically quoted.
24. Unloading and Staircase Charges
Where lift access is unavailable:
- Material movement above the 2nd floor may attract additional unloading charges.
- Such charges will be communicated in advance.
25. Communication and Support
For all project-related communication, Customers are advised to use the contact details provided on our website.
26. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
27. Amendments
Eviz Design reserves the right to modify these Terms and Conditions at any time without prior notice.
Updated versions will be published on this website.
28. Acceptance of Terms
By making any payment, approving a quotation, or allowing work to commence, the Customer confirms that they have read, understood, and agreed to these Terms and Conditions.
